HOSTING TERMS OF SERVICE (TOS)
Welcome to Atomx1. By signing up for any of our hosting services, you agree to be bound by the following terms and conditions. Atomx1 provides hosting services to customers worldwide, and we have a responsibility to protect each client and provide the best services available. The following guidelines have been established to ensure this intent is met.
Agreement
By using Atomx1 services, you agree to the following terms and conditions. Atomx1 may update these terms and conditions at any time without prior notice.
Fees
2.1. Payment is due on the anniversary date of the month for the hosting plan selected by the customer. All fees are non-refundable.
2.2. Failure to pay fees when due may result in suspension and possible termination of your account.
2.3. Atomx1 reserves the right to modify its fees and charges and to introduce new charges at any time. Notification of such changes will be provided in advance to the customer.
Account Setup
3.1. Setup of your account will occur after receipt of payment.
3.2. You are responsible for providing Atomx1 with accurate and up-to-date information during the registration and setup process.
3.3. Only one account may be created per customer unless special arrangements have been made.
3.4. Accounts are for the use of the customer only and cannot be resold or given away without the prior written consent of Atomx1.
Content and Usage
4.1. Atomx1 services may only be used for lawful purposes.
4.2. You are responsible for ensuring that any content uploaded to your account does not violate any laws, infringe on any third-party rights, or violate the Atomx1 Acceptable Use Policy.
4.3. The following types of content are prohibited: child pornography, pirated software, spamming, malicious scripts or code, and any content that violates US law.
4.4. Atomx1 reserves the right to remove any content that violates these terms and conditions or any other policy of Atomx1.
4.5. Atomx1 may terminate your account at any time if it is determined that your use of the service is in violation of these terms and conditions or any other policy of Atomx1.
Backups
5.1. Atomx1 performs regular backups of customer data to ensure the integrity of customer information.
5.2. Atomx1 will not be held responsible for any loss of data resulting from a failure of our backup systems or for any data that has not been backed up.
Uptime Guarantee
6.1. Atomx1 provides a 99.9% uptime guarantee for all hosting services.
6.2. Any downtime that is not part of scheduled maintenance and that exceeds the 99.9% uptime guarantee will be credited to your account.
6.3. The credit will be calculated as follows: for every hour of downtime exceeding the 99.9% uptime guarantee, one day of service will be credited to your account.
Indemnification
You agree to indemnify and hold Atomx1, its affiliates, subsidiaries, officers, directors, employees, and agents harmless from any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to your use of the Atomx1 services or your violation of these terms and conditions.

Atomx1 makes no warranties of any kind, whether expressed or implied, for the services it provides. Atomx1
